Solicitation/Notice of Intent The intent of this Solicitation Notice is for informational purposes only. The U.S. Department of Agriculture, Agricultural Research Service (ARS), Contracting Operations Branch (COB) intends to award a negotiated Firm Fixed Price, sole source contract on behalf of the USDA ARS Facilities Division (FD) to Skillsoft Corporation for Environmental, Safety and Health (ESH) courseware collection licenses. Skillsoft is the only vendor that has proprietary software licenses that are currently compatible with USDA’s Learning Management System, AgLearn. Therefore, no competitors currently meet FD’s requirements to support ESH courseware within AgLearn. The proposed contract will be awarded using a Limited Source Justification (LSJ) pursuant to FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. The LSJ is attached for reference. The synopsis does NOT constitute an Invitation for Bids (IFB), a Request for Proposals (RFP) or Request for Quotes (RFQ) nor does it restrict the Government as to its ultimate acquisition approach. The Government does not intend to award a contract on the basis of this notice, nor will it reimburse firms for any costs associated with preparing or submitting a response to this notice. However, all responsible sources, meeting the requirements including the ability to meet ARS/FD’s training requirements which, if received within 10 calendar days of publication of this notice shall be considered by the Government. All responses must be submitted to the Government primary point of contact at the contracting office address shown below. If no written responses are received after the publication of this notice, the contract will be awarded without further notice. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government.

This is a Sources Sought Announcement issued by the United States Department of Agriculture (USDA) for informational and planning purposes only. This is NOT a solicitation, nor is it an announcement for a forthcoming solicitation. Submission of any information in response to this notification is purely voluntary. The Government assumes no financial responsibility for any costs incurred in providing a response. The USDA has a requirement for Environmental, Safety, and Health Courseware Collection to provide courses to address a wide range of ES&H requirements including OSHA, EPA, DOT, NFPA, and IATA laws and regulations in accordance with the attached salient characteristics. Responses to this notification will help to determine the acquisition strategy for any future solicitation.
