Amendment 0003 extends this RFP until 8/18 at noon, strikes 2.6.1 and 2.6.2 per vendor feedback, and adds the following language: Notwithstanding the prohibitions contained in the Agreement, Customer may disclose aggregated data from the Final Archive Files and Customer Work Product outside the Consumer Financial Protection Bureau in connection with the Project to which such Final Archive Files relate, only if Customer provides the vendor with advance written notice of the disclosure and vendor approves the disclosure in writing. Vendor will endeavor to communicate its decision within ten (10) business days following its receipt of Customer’s notice. vendor will make such determination in its sole discretion based on the following factors: (i) potential injury to vendor’s business or reputation, (ii) level of aggregation, (iii) accuracy of the data to be published, and (iv) compliance with law or regulation. Customer will not charge any fee for its publication of aggregated data from the Final Archive Files unless agreed in writing by vendor. For purposes of clarity, in no event will Customer be permitted to disclose any of the individual-level data in the Final Archive Files pursuant to the foregoing provision. Once Work Product has been approved for publication by vendor, Customer may publish, republish or allow a third party to publish such approved Work Product. Vendor agrees that vendor has no right, title, or interest in the results of any Customer research and analysis based on the Final Archive Files, including any Customer Work Product.
