The Office of Enforcement needs a two-day, in-house custom Trial Advocacy program for its attorney staff members, to be delivered at CFPB's office located at 1700 G Street, NW, Washington, D.C., during Spring/Summer 2020. WebEx may also be utilized at the discretion of the Contracting Officer's Representative. The program must be specifically tailored to the needs of ENF with a case file/fact patterns to be created based upon cases litigated by ENF. The program faculty must consist of at least 4 highly experienced trial attorneys, including law professors involved with trial advocacy programs at American Bar Association (“ABA")-accredited U.S. Law schools. All faculty members must be licensed in one or more state bar associations and have at least 10 years of litigation experience. Each of the two days of training must consist of 5.0 hours of instruction plus two 15-minute breaks and a 1-hour lunch break. The program must be accessible to ENF staff members located in ENF's field offices via telephone link (audio access) and Web-Ex (visual access). Technology accessibility will be provided by the CFPB. The Office of Enforcement currently has attorney staff members who are required to engage in complex civil litigation daily. These staff members need a high quality, comprehensive Litigation Skills course that covers the specific subject matter listed below: - Evidence Primer, - Admitting and Using Exhibits, - Incorporating Exhibits and Refreshing Recollection, - Impeachment, - The Importance of a Cohesive Case, - Opening Statement & Closing Argument, - Advanced topics in Direct Examination, and - Creating the perfect Cross-examination. The Litigation Skills course must provide instruction on the following topics: Overview and refresher of the Federal Rules of Evidence, Objection and response formula how-tos, Ensuring a complete hearing record, Foundational requirements for different exhibits, Publishing and using exhibits, How to use demonstratives, Effectively publishing exhibits to emphasize theories, An introduction to Trial Director and PowerPoint, Preparing for impeachment, Defending the impeached witness, How to impeach witnesses through prior inconsistent statements, Innovative ways to brainstorm a case, Identifying a winning theme and theory, Emphasis on storytelling, Persuasive advocacy in jury voir dire, Implementing the theme and theory in opening and closing, Appealing to ethos, pathos, and logos, Creating a narrative through the witness, Unique and innovative ideas for structuring examinations, Emphasis on storytelling, Brainstorming the structure of a cross-examination, The best format of questions, Practice Pointers for effectively presenting theme & theory on cross-examination, and Disciplining the difficult witness. Instruction must be provided in the form of lecture and demonstrative exercises. Fact patterns must be based upon cases litigated by the Office of Enforcement. The training format for demonstrations must simulate a realistic courtroom setting. During the demonstrations, TACT faculty will assume the roles of judge, plaintiff, defense counsel, and a commentator providing feedback about “how-tos" for each subject area. Training must include live demonstrations of the following skills: Pre-trial motions and objections during direct- and cross-examination, Best practices for admitting exhibits, Refreshing recollection and optimizing technology, Proper and improper impeachments, and Opening Statement and Closing Argument. They are licensed attorneys who have at least 10 years of litigation experience and include professors at ABA-accredited U.S. law schools who teach Trial Advocacy, as detailed in the vendor’s proposal. - Only TACT can furnish the requirements, to the exclusion of other sources, because no other vendor offers the variety and depth of topics necessary to meet the needs of Office of Enforcement attorney staff for comprehensive instruction on Litigation Skills.
