The Commodity Futures Trading Commission (CFTC) intends to procure digital access to the Financial Times enterprise level online subscription on a sole source basis. In carrying out the agency’s mission, CFTC requires access to real-time, business, finance and economics from around the world. Specifically, FT.com provides news and commentary in these subject areas written by journalists and commentators exclusively for the Financial Times that is required by CFTC which is available through the identified Financial Times product. This information is necessary to make informed research based decisions on proposed regulations and enforcement actions. The Government intends to procure this requirement under 41 U.S.C. §3304 (a)(1) and FAR 13.106-1(b)(1)(i) which states "the circumstances of the contract action deem only one source reasonably available." The identified vendor is the sole provider of the information and data required by CFTC. The anticipated contract will have a period of performance of base period of one (1) year and two (2) one (1) year optional periods. This vendor is the only responsible source identified as reasonably available that will satisfy the agency requirements. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and a solicitation will not be issued. However, the Government will consider responses from all responsible sources received by the date and time identified above. Written responses must include sufficient information to establish capability to fulfill the requirement. Oral communications are not acceptable in response to this notice. Any responses received will only be considered for the purposes of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice, and such determination shall be made at the sole discretion of the CFTC.
