The Commodity Futures Trading Commission (CFTC) intends to award a sole source purchase order to Executive Maintenance Inc. (EMI) for supplemental cleaning services for the leased office space of CFTC’s headquarters building, located at 1155 21st Street, NW, Washington, DC 20581. CFTC leases office space from LCPC Lafayette Property LLC (LCPC). LCPC has directly contracted with EMI for the janitorial services. LCPC pays for basic janitorial services for the tenants to include daily cleaning of the leased office space; however tenants must pay for services such as carpet spot cleaning and periodic overall carpet cleaning, and pantry maintenance. LCPC does not permit other contractors into their building space to perform these services. The period of performance of the purchase order will be for a base period of one (1) year from May 1, 2023 through April 30, 2024, and two one (1) year option periods. This procurement action is being performed pursuant to FAR 13.106-1(b), Soliciting from a single source: (1) For purchases not exceeding the simplified acquisition threshold, (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). The authority for permitting other than full and open competition is 41 U.S.C.3304(a)(1), as the cleaning services needed by CFTC are restricted to only one source directly contracted with the landlord. This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the response date and time identified in this synopsis. Written responses must include sufficient information to establish capability to fulfill the requirement. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source contract described in this notice, and such determination shall be made at the sole discretion of CFTC.
