The Commodity Futures Trading Commission (CFTC) intends to award a contract to Vertex Analytics on an other than full and open competitive basis to renew the licenses for access to its commercial-off-the-shelf (COTS) hosted order book data and visualization software required to facilitate the use of the data in support of prospective and ongoing litigation as well as economic analysis. Specifically, CFTC intends to contract with Vertex for six (6) V3 Platform licenses including technical support and access to the hosted order book data. The contract will be for one (1) year with four one (1) year options to extend the period of performance. Vertex Analytics is the only source that CFTC is aware of which provides a visualization software application (V3 Platform) with access to years of order book data. This procurement action is being conducted under FAR 6.302-1 with the authority of 41 U.S.C. 3304(a)(1), as the information required by CFTC is available from only one responsible source and no other type of supplies or services will satisfy CFTC's requirements. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS nor a solicitation of offers. However, the Government will consider written responses from all responsible sources received by 5:00pm ET, July 12, 2021. Written responses must include sufficient information to establish capability to fulfill the requirement. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the Government. Information received will be considered solely for the purposes for future Market Research requirements. No formal solicitation package is available. The Government anticipates award on or about September 20, 2021. The Government will not be responsible for any costs of preparation in response to this announcement.
