The Commodity Futures Trading Commission ("CFTC") intends to negotiate and award a sole-source contract for the procurement of Nexidia Relativity Integration Module and Maintenance from NICE Systems. The Government intends to procure this requirement under FAR 13.106-1(b)(1) – only one source is reasonably available. CFTC intends to award a purchase order with one base year, and four option years, for a total period of performance of five (5) years. The Nexidia software is the only audio repository software that works specifically with Relativity, which is CFTC’s comprehensive document review platform. The Nexidia Relativity Integration Module will allow CFTC staff to search for audio using Nexidia within the Relativity application. NICE Systems is the only manufacturer of the Nexidia Relativity Integration module. No other modules or applications work specifically with Relativity and Nexidia in allowing users to view and review both electronic and audio files within the same application. CFTC knows of no alternative source that can provide an integrated audio repository and search software with the Relativity document review platform. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS nor a solicitation of offers. However, the Government will consider written responses from all responsible sources received by 10:00AM ET, September 6, 2021. Written responses must include sufficient information to establish capability to fulfill the requirement. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the Government. Information received will be considered solely for the purposes for future Market Research requirements. No formal solicitation package is available. The Government anticipates award on or about September 8, 2021. The Government will not be responsible for any costs of preparation in response to this announcement.
