This is the J&A for other than full and open competition npursuant to the authorities under the Expedited Acquisition and Assistance Procedures Package (EPP) for Ukraine, Belarus, and Moldova, approved on March 6, 2022 by the Administrator. USAID Moldova intends to negotiate and award Moldova Institutional and Structural Reforms Activity (MISRA), a one cost plus fixed fee (CPFF) completion contract with a period of performance of five (5) years and a total estimated cost of $35,000,000. Pursuant to the authority set forth in AIDAR 706.302-70(b)(3) and 40 U.S.C. §113, and Expedited Procedures Package (EPP) for Ukraine, Belarus, and Moldova approved by the USAID Administrator on March 6, 2022, this will be a sole source procurement with Nathan Associates. The approved EPP provides authorization to except competition for new awards. USAID has implemented this provision through 48 CFR §706.302-70(b)(3)(ii), which provides an exception to competition for "awards for countries, regions, projects, or programs for which the Administrator of USAID made a formal written Determination and Findings (D&F). The use of the EPP authority for using less than full-and-open competitive procedures for MISRA procurement will allow the Mission to expeditiously implement the activity in as responsive a manner as possible, supporting reforms and programs to stimulate economic recovery. The prupose of the activity is to stimulate a sustainable and inclusive recovery from the regional crisis, improve the institutional, business, and trade enabling environment in Moldova by supporting Moldova’s public institutions and the private sector to accelerate the implementation of trade liberalization mechanisms, adopt structural and investment climate reforms, accelerate financial sector reforms, improve economic governance in the public sector, and enhance strategic communications between the private and public actors.
