1.0 DESCRIPTION This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice, a... 1.0 DESCRIPTION This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice, and shall be processed in accordance with FAR Part 13 - Simplified Acquisition Procedures. This announcement constitutes the only solicitation, and a separate written solicitation will not be issued. This solicitation, 75N91021Q00261, is issued as a request for quote (RFQ) and includes all applicable provisions and clauses in effect through FAR Federal Acquisition Circular (FAC) 2021-06 (07-12-2021), simplified acquisition procedures for commercial items. The North American Industry Classification System code is 541380 and the business size standard is $16.5 million. 2.0 BACKGROUND The Department of Health and Human Services (HHS), National Institutes of Health (NIH), National Cancer Institute (NCI), Center of Cancer Research (CCR), Urologic Oncology Branch (UOB) focuses on clinical and basic research designed to develop better methods for detecting, preventing, and treating patients with kidney cancer, prostate cancer, and bladder cancer. Through the recruitment of patients with a hereditary predisposition to kidney cancer, UOB has identified the underlying genetic causes for many of these patients, but a large number of patients still require investigation. In addition, once the germline mutation has been identified it is important to catalogue and understand what other additional somatic (acquired) changes are occurring within the tumor. Whole exome sequencing (WES) has provided an excellent platform for investigating both the underlying germline changes and the additional somatic changes. Commercial WES has become more and more economic and effective at providing high quality data and providing established pipelines for the initial analysis of the raw data. This initial analysis step is vital to UOB by reducing the time required for the study. Data derived from these studies can be invaluable for patient management and care. Once germline mutations are identified patients can be more effectively managed, obtain appropriate kidney screening, and potentially gain supplementary screening for additional symptoms associated with the identified mutation. The decision to perform surgery or utilize active surveillance and the choice of systematic therapy is influenced by the germline alterations that are found. The somatic mutations are also essential for UOB’s understanding and therapeutic targeting of specific tumors. Some somatic mutations are directly associated with more aggressive disease, influencing patient management, or with responses to specific drugs, thus influencing treatment. Understanding what pathways and mechanisms are mutated in the tumors can also give UOB a wider view of what has gone wrong within the tumor and what pathways could be therapeutically targeted due to UOB’s increased understanding. 2.1 OBJECTIVE The primary objective of this procurement is to perform human whole exome sequencing and analysis on 160 tumors and associated normal blood DNAs using a next-generation sequencing system capable of generating 150bp paired end reads to provide 12 G of raw data per sample that will translate to an average of 100x coverage per tumor. The bioinformatic analysis shall be performed by the contractor and shall include: Data quality control: filtering reads containing adapter or with low quality, Alignment with reference, statistics of sequencing depth and coverage, SNP and InDel calling, annotation and statistics, Somatic variant detection - SNP calling, annotation and statistics, InDel calling, annotation and statistics, CNV calling, annotation and statistics. 3.0 SCOPE The Contractor shall provide all labor, material, and equipment necessary to perform human whole exome sequencing of 160 tumors and associated normal blood DNAs and provide bioinformatic analysis of the raw data acquired. NCI shall ship samples on dry ice via standard shipping to the Contractor within 20 business days of award. Shipping fees shall not be included in this order. The contractor shall provide the raw data and bioinformatic analysis report to NCI once the tasks are completed. All data shall be coded and shall not contain any personally identifiable information (PII). 4.0 CONTRACT REQUIREMENTS/ AND PERSONNEL QUALIFICATIONS The Contractor shall perform the following tasks: 4.1 The contractor shall receive the sample shipment from NCI and the contractor shall store the samples at no less than -20? C until analysis begins. 4.2 The contractor shall perform a quality control check on the received DNA and report the findings electronically to the NCI technical point of contact (TPOC). before proceeding. 4.3 The contractor shall perform human whole exome sequencing using a next-generation sequencing system capable of generating 150bp paired end reads to provide 12 G of raw data per sample that will translate to an average of 100x coverage per tumor. 4.4 The contractor shall process the raw data using their established pipelines, and provide the raw data to the NCI technical point of contact (TPOC). 4.5 The contractor shall provide an electronic report to the NCI TPOC detailing the Data quality control (filtering reads containing adapter or with low quality), Alignment with reference, statistics of sequencing depth and coverage, SNP and InDel calling, annotation and statistics, Somatic variant detection - SNP calling, annotation and statistics, InDel calling, annotation and statistics, CNV calling, annotation and statistics. 5.0 TYPE OF ORDER This is a Firm Fixed Price Purchase Order. 6.0 NON-SEVERABLE SERVICES The services specified in each contract line item (CLIN) have been determined to be non-severable services - a specific undertaking or entire job with a defined end product of value to the Government. 7.0 PERIOD OF PERFORMANCE The period of performance (POP) shall be 12 months from the date of award. 8.0 PLACE OF PERFORMANCE Services shall be performed at the Contractor’s facility. 9.0 REPORT(S)/DELIVERABLES AND DELIVERY SCHEDULE All written and electronic deliverable products shall be submitted to the Technical Point of Contact (TPOC), as specified below, within the timeframes listed in the deliverable table. The Technical Point of Contact is: TBD at Award. Within 60 business days of award 10.0 PAYMENT Payment shall be made after delivery, inspection, and acceptance of the final report by the Government. Payment authorization requires submission and approval of invoices to the TPOC and NIH OFM, in accordance with the payment provisions listed below: The following clause is applicable to all Purchase Orders, Task or Delivery Orders, and Blanket Purchase Agreement (BPA) Orders/Calls: Prompt Payment (Jan 2017) FAR 52.232-25. Highlights of this clause and NIH implementation requirements follow: I. Invoice Requirements A. An invoice is the Contractor's bill or written request for payment under the contract for supplies delivered or services performed. A proper invoice is an "Original" which must include the items listed in subdivisions 1 through 12, below, in addition to the requirements of FAR 32.9. If the invoice does not comply with these requirements, the Contractor will be notified of the defect within 7 days after the date the designated billing office received the invoice (3 days for meat, meat food products, or fish, and 5 days for perishable agricultural commodities, dairy products, edible fats or oils) with a statement of the reasons why it is not a proper invoice. Description of supplies/services that match the description on the award, by line billed.* 11. Freight or delivery charge must be billed as shown on the award. If it is included in the item price do not bill it separately. If identified in the award as a separate line item, it must be billed separately. 12. A modification to the order or contract may be needed before the invoice can be submitted and paid. B. Shipping costs will be reimbursed only if authorized by the Contract/Purchase Order. If authorized, shipping costs must be itemized. Where shipping costs exceed $100, the invoice must be supported by a bill of lading or a paid carrier's receipt. C. The Contractor shall submit invoice to the National Institutes of Health/Office of Financial Management (NIH/OFM) via email at invoicing@nih.gov with a copy to Contracting Officer, Contracting Officer’s Representative, and Program point of contact, as directed. The invoices must be emailed in accordance with instructions below. Do not submit supporting documentation (e.g., receipts, time sheets, invoices, etc.) with your payment request unless specified elsewhere in the contract or requested by the Contracting Officer. The invoice shall be transmitted as an attachment via email to the address listed above in one of the following formats: Word, or Adobe Portable Document Format (PDF). The Contractor must submit only one invoice per email. Please Note: NIH/OFM will not accept invoices postmarked and/or delivered in-person on/after December 1, 2020. II. Invoice Payment A. Except as indicated in paragraph B., below, the due date for making invoice payments by the designated payment office shall be the later of the following two events: 1. The 30th day after the designated billing office has received a proper invoice. 2. The 30th day after Government acceptance of supplies delivered or services performed. B. The due date for making invoice payments for meat and meat food products, perishable agricultural commodities, dairy products, and edible fats or oils, shall be in accordance with the Prompt Payment Act, as amended. III. Interest Penalties A. An interest penalty shall be paid automatically, if payment is not made by the due date and the conditions listed below are met, if applicable. 1. A proper invoice was received by the designated billing office. 2. A receiving report or other Government documentation authorizing payment was processed and there was no disagreement over quantity, quality, or contractor compliance with a term or condition. 3. In the case of a final invoice for any balance of funds due the contractor for supplies delivered or services performed, the amount was not subject to further settlement actions between the Government and the Contractor. B. Determination of interest and penalties due will be made in accordance with the provisions of the Prompt Payment Act, as amended, the Contract Disputes Act, and regulations issued by the Office of Management and Budget. IV. PROVIDING ACCELERATED PAYMENT TO SMALL BUSINESS SUBCONTRACTORS, FAR 52.232-40 (December 2013) a. Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor. b. The acceleration of payments under this clause does not provide any new rights under the prompt Payment Act. c. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form.
