The Food and Drug Administration intends to make a sole source award for a Preventative Maintenance Service Plan for a Bruker D2 Phaser XRD Instrument. The award will be made to: Bruker AXS, Inc 5465 East Cheryl Parkway Madison, WI 53711-5373 In accordance with FAR 6.302-1, FAR 13.106(b) and FAR 5.203, Only one responsible source and no other supplies or services will satisfy agency requirements. The FDA requires a preventative maintenance service plan for a Bruker D2 Phaser XRD to conduct qualitative analyses of color additive and cosmetic samples with minimum sample preparation. Bruker AXS Inc is the original equipment manufacturer and sole source provider of OEM software updates that ensure compatibility with FDA computer requirements. As the original manufacturer of the equipment, Bruker AXS Inc is the only organization that can provide the OEM software updates and OEM certified engineers to maintain optimum performance and minimizing downtime, as required by the FDA. This element of the maintenance agreement prevents unacceptable delays and prevents substantial duplication of cost to the Government that is not expected to be recovered through competition. Therefore, it is in the best interest to the government to award a sole source maintenance agreement to Bruker AXS, Inc.
