The Regional Health Contracting Office - Pacific, in support of Tripler Army Medical Center (TAMC), Hawaii, intends to make a sole source award to Nuvasive for the urgent purchase of spinal implant components for the Department of Surgery at TAMC, Hawaii. The physician requesting the supplies has verified the need for these Nuvasive products to ensure the best possible outcome for the patient. Therefore, these surgical implants are the only ones that can meet the Government's current need. Nuvasive is the sole provider of these surgical spinal implants. The authority permitting this award without providing full and open competition is cited in FAR 13.106-1 (b)(1)(i) which authorizes the government to award contracts when there is only one source reasonably available (e.g. urgency, exclusive licensing agreement, brand name or industrial mobilization).
